Comments on Proposed Changes to Wisconsin’s Bullying Law (2013 Senate Bill 184)(October 3, 2013)
The Wisconsin Senate Committee on Education is meeting today to discuss a proposal to revise the state’s bullying law. You can read the text of the bill here. Should Cities Have a Cyberbullying Ordinance? (October 15, 2012)
I have received quite a few inquiries in the last several months from local elected officials who are interested in proposing a city or county ordinance to address cyberbullying. Several cities in my home state of Wisconsin have recently passed ordinances (e.g., Viroqua; Franklin).  In addition, a number of cities in Missouri enacted local ordinances prohibiting cyberbullying following the tragic suicide of Megan Meier in 2006.  At that time, there appeared to be very few legal (criminal) options to hold someone accountable for cyberbullying or other forms of online harassment. The question to consider is whether a local cyberbullying ordinance is the right way to tackle this problem.  Here are my thoughts on this issue.

Another Well-Meaning, but Unfunded Mandate to Address Bullying (September 1, 2011)
New Jersey’s updated bullying law took effect today amid controversy and confusion.  The New York Times recently reported on the law and I have received numerous calls from folks interested in my take on certain provisions.  Bullying and cyberbullying legislation has been the topic of much discussion on this blog, and regular readers know that we see a place for evidence-based, fiscally supported state legislation that helps clarify school responsibilities and provides them with the tools to better manage bullying and cyberbullying incidents.  We haven’t seen the perfect law yet, and New Jersey’s iteration is not it either.

Cyberbullying: A Review of the Legal Issues Facing Educators (February 18, 2011)
School districts are often given the challenging task of addressing problematic online behaviors committed by students while simultaneously protecting themselves from civil liability by not overstepping their authority. This is difficult, because the law concerning these behaviors is ambiguous and continuously evolving, and little consensus has yet been reached regarding key constitutional and civil rights issues. In the present article, the authors aim to shed light on some of the critical legal questions faced by school administrators by first reviewing several legislative actions and court cases involving problematic offline and online student speech or expressions. Next, the authors analyze the dispositions and extract principles that can inform and direct prevention and response efforts by educators. They conclude by underscoring the challenges of balancing legal guidance with humane consideration of the context and consequences of cyberbullying victimization among youth.

Cyberbullying Laws and School Policy: A Blessing or Curse? (September 28, 2010)
Many schools are now in a difficult position of having to respond to a mandate to have a cyberbullying policy, without much guidance from the state about the circumstances under which they can (or must) respond. When folks ask me if I think there needs to be a “cyberbullying law” I basically respond by saying “perhaps – but not the kind of law most legislators would propose.” I would look for a law to be more “prescriptive” than “proscriptive.”

SAFETY ADVOCATE FAILS ... STALKING VICTIMS

The family of a 7-year-old boy is grieving after he was attacked and killed by multiple dogs at a home in the Canyon Lake area on Saturday evening.

Smith said although the dogs were unspecified breeds, none of them were pit bulls.
Heartbreaking but the DBO sharks are circling the waters. 
  
A 7-year old boy died and all of these “victims advocates” more concerned with trying to prove the dogs are pit bulls- even though the story says they are not. Not a care about the grieving family…
  
Yet again- not a story about pit bulls but a family losing their 7 year old child yet DBO/BSL advocates can’t help themselves.
  
I’m amused by their arrogance- they demand to stick their nose into this families tragedy. Why? So they could terrorize this family.  
  
Let me guess- Borchardt feels he can be the unbiased 3rd party? Yeah, right. You would think as a victims advocacy their first step would be compassion and respect- but nope. That’s not how BSL/DBO victims advocacy works. If they can’t somehow spin these dogs into pit bulls this family won’t even matter to them.
  
And trust me- they are trying everything to turn this tragedy into a pit bull issue- in their desperation they are already trying to get people to call it a pit bull attack.
Like sharks circling their prey- the stalking has began.
   
 
  Although- they should be careful when stalking this family, the people in blue don’t take kindly to extremist stalking their own.

He thinks he is. He’s not. He proves it a lot. Once again, this is why no one of any intelligence will EVER listen to him.

The American Bulldog is actually an offshoot of Mastiffs (which also are NOT pit bulls). This moron makes my eye twitch.
If you would like to read a VERY good article about the differences between “pit bulls” and “American Bulldogs” read this. This article goes in detail about the differences between the dogs both in history, use, breeding, size and physical conformation.
Here’s a sample:
The term “Pitbull” refers to three breeds of dog: The American Pit Bull Terrier, the American Staffordshire Terrier, the Staffordshire Bull Terrier, and crossbred dogs between any of the three. In an effort to create small, very strong, agile, and tenacious working dogs for cattle management, all three dogs, as well as their genetic progenitors, were similarly developed by crossbreeding various Terrier dogs to Bulldogs.
The Bulldog most commonly used was the short, squashed nosed lapdog, known as the English Bulldog, and NOT the American Bulldog. This is an important historical distinction. The English Bulldog of that time, was a direct and recent descendent of fighting dogs, a sport in the process of being outlawed in England. Those English Bulldogs – or what was in that era in England and Ireland, simply called a Bulldog, bred to equally aggressive Terrier specimens, created the original, and previously much more aggressively bred Pitbull.
In contrast, an American Bulldog is a Mastiff offshoot, cousin to the Bullmastiff and descendent of other Mastiff bred dogs. The American Bulldog’s Mastiff bred progenitors were not primarily used in dog fighting at all, but for hunting, homestead protection and cattle management. Obviously in more recent American history, both dogs were once misused in dog fighting, however, among those well known characters doing the dog fighting in early 1900s America, the American Bulldog was considered not fit for the sport, because of its much lesser instinctive inclination towards dog-on-dog fighting. In other words, the American Bulldog was not successfully bred for dog fighting, even by those who tried it.
In any event, the Pitbull is a Terrier, most typically with all the associated and relatively well known “small dog” tendencies of the dogs in the Terrier group, tendencies not typically shared with the larger, and somewhat less energetic American Bulldogs.

JEFF D BORCHARDT- A REAL CHARMER!

This interview with Jeff Borchardt, anti-Pit Bull hatemonger, is a total misrepresentation of actual reality. How many lies can be packed into 45 seconds?
First of all, this piece states that Mr. Borchardt had “no concern” with the dogs being around his baby. This isn’t true, as he’s stated numerous times that the dogs were to remain kenneled in a yard outside and never to be around his son. Yet, he now blames ALL dogs for his son’s death and not the actual babysitter who violated his request… And I’m certainly not saying she needs blamed, but if he’s hellbent on blaming someone in order to process his grief then maybe he should start with focusing on the individuals who were actually involved with Daxton’s death. This babysitter, Susan Iwicki, has now conveniently became as vicious in her sweeping anti-dog ideologies as Borchardt is, which surely comes in handy for the cause of trolling the internet using a multitude of fake profiles to spread hate against all Pit Bulls and all dog owners. Also, in this story Borchardt claims to have not only known and liked the dogs, but talks as if he has all kinds of personal insight into their actual characters. More disingenuous, reconstructed and dressed up nonsense. This is aside from the numerous erroneous factoids he attempts to jam into his last sentence that they air for their piece. Last, it’s claimed that his organization doesn’t seek a ban on Pit Bulls, yet there’s years of his own statements available online that tell otherwise. Represent yourself honestly in public, man!
These tactics of inconsistency are always present when the few DogsBite followers (rarely) come out and present their ideas to the non-controlled public. Colleen Lynn does the exact same thing, ramping down her rhetoric to appear only 75% psychotic instead of a raging 125%. Again, be real. It speaks volumes when you can’t be.

It’s also stated on this website that 26 different dog breeds are considered (by Borchardt) as “potentially dangerous.” Lol. First off, from his angle (which is to vilify entire breeds and types) this is total bullshit. Secondly, semantically speaking every single dog, as well as any other animal and any other person or object, is “potentially” dangerous. But anyways, his Daxton’s Friends website sweepingly proclaims that all American Bulldogs, American Pit Bull Terriers, American Staffordshire Terriers, Bull Terriers, Miniature Bull Terriers, Staffordshire Bull Terriers, Great Danes, St. Bernards, Rottwilers, Akitas, Boxers, Alaskan Malamutes, Chows, Dobermans, German Shepherds, Shar Peis, Siberian Huskies, Olde English Bulldogs, Bullmastiffs, Cane Corsos, Dogo Argentinos, English Mastiffs, Fila Brasileiros, Dogue de Bordeauxs, and Presa Canarios are a detriment to public safety and should be regulated. Nice guy.
When addressing a control freak like Borchardt I oftentimes speak of the concept of collective blame. Instead of being specific and holding the individuals involved accountable, this concept instead scapegoats massive groups of uninvolved individuals and promotes the erroneous philosophy ofprecrime. Jeff Borchardt displays this way of thinking in absolute spades… Pit Bulls aside, look at this post from September of last year where he blames “pro-Pit Bull organizations,” Best Friends, the National Canine Research Council, Animal Farm Foundation, Bad Rap, Pit Bulletin Legal News Network, the ASPCA, the HSUS, the Center for Disease Control Prevention, the American Veterinary Medical Association, Shorty Rossi and the show “Pit Boss,” Tia Torres and the show “Pit Bulls and Parolees,” Cesar Millan and the show “The Dog Whisperer,” and any parent out there who might dare post a photo of their dog with their children onto Facebook for killing his son Daxton Borchardt. You are all to blame!
Below is Borchardt using the phrase “die out” or “bred out,” which alludes to his softer public stance of mandating sterilization laws onto Pit Bulls instead of outright bans. This is what many from the DogsBite cult will speak of now, which allows them to publicly hide their true intent behind the misnomers of caring about any overpopulation, Pit Bull shelter deaths, or any abuse that any individual dog may suffer at the hands of a person. Much like PETA, they will say that they are doing it for the dog’s “own good and protection.” To the laymen who has no idea either way this presents a picture of a less extreme person who, instead of calling for an eradication roundup, is simply calling for a spay and neuter law with the grandest of intentions. Without any context or background this incredible disingenuousness sometimes goes unaccounted for…

I don’t know Jeff Borchardt personally. I certainly have empathy and compassion for him, person to person, in regards to the tragic loss of his son’s life. What he’s went through I wouldn’t wish on anyone, ever. But sadly, with this issue he’s constantly shown himself to be a reprehensible, classless, ignorant and despicable person who’s allowed his grief to literally turn him into a flagrant monster.
